1. Acceptance of These Terms

Welcome to Mattus Fine Art.

These Terms & Conditions ("Terms") govern your access to and use of the Mattus Fine Art website, online store, products, services, memberships, educational programs, digital downloads, artwork, handmade products, and other content offered by Mattus Fine Art and its affiliated brands.

Mattus Fine Art is the parent company of several creative and educational brands, including Mindful Artist Academy and Tiani's Handmade. Unless otherwise stated, these Terms apply to all products, services, content, communications, and offerings provided under any of these brands through the Mattus Fine Art website.

By accessing or using our website, creating an account, purchasing a product or service, enrolling in a course or membership, downloading digital content, participating in workshops or events, subscribing to our email communications, or otherwise interacting with us, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions and our Privacy Notice.

If you do not agree to these Terms, you should not access or use our website, products, or services.

These Terms constitute a legally binding agreement between you and Mattus Fine Art and apply to all current and future products, services, content, and offerings unless a separate written agreement expressly states otherwise.

Mattus Fine Art is a Florida-based creative business dedicated to helping people discover creativity through fine art, education, and handmade products.

Mattus Fine Art owns and operates the following brands:

Mattus Fine Art
Original artwork, fine art prints, commissioned artwork, educational resources, workshops, and related products and services.

Mindful Artist Academy
Online courses, workshops, educational resources, coaching, mentoring, digital products, and future membership programs for artists and creative individuals.

Tiani's Handmade
Handmade blankets, plush toys, gifts, knitting patterns, digital downloads, tutorials, educational resources, and related handmade products.

Mattus Fine Art owns and operates the Mattus Fine Art website and all products, services, educational programs, digital content, memberships, and online store offered under these brands. Unless expressly stated otherwise, all purchases, payments, contracts, customer communications, and legal obligations are entered into with Mattus Fine Art.

Throughout these Terms & Conditions, the terms "Mattus Fine Art," "we," "our," and "us" refer collectively to Mattus Fine Art and its affiliated brands, including Mindful Artist Academy and Tiani's Handmade, unless the context clearly indicates otherwise.

3. Scope of These Terms

These Terms govern your use of our website and all products, services, content, communications, and offerings provided by us, including those offered through Mattus Fine Art, Mindful Artist Academy, and Tiani's Handmade.

These Terms apply whether you:

• Visit or browse our website.
• Create an online account.
• Purchase original artwork, fine art prints, handmade products, or gifts.
• Purchase digital products or downloadable content.
• Download knitting patterns or educational materials.
• Enroll in online courses, workshops, or coaching programs.
• Participate in memberships or subscription services.

• Join a waitlist.
• Subscribe to newsletters or marketing communications.

Certain products or services may be subject to additional terms, licenses, refund policies, participation agreements, or promotional conditions. 4. Eligibility

By accessing our website or purchasing any product or service, you represent and warrant that:

• You have the legal capacity to enter into a binding agreement.

We reserve the right to refuse service, reject orders, suspend or terminate accounts, cancel transactions, or restrict access to our website or services if we reasonably believe these Terms have been violated or that fraudulent, unlawful, abusive, or unauthorized activity has occurred.

5. Products & Services

We offer a variety of creative, educational, digital, and physical products and services through Mattus Fine Art and its affiliated brands, including Mindful Artist Academy and Tiani's Handmade.

Our products and services may include, but are not limited to:

• Original artwork
• Commissioned artwork
• Fine art prints
• Handmade blankets, plush toys, gifts, home décor, and other handcrafted products
• Digital knitting patterns
• Downloadable PDF guides, templates, workbooks, and educational resources
• Online courses and self-paced educational programs
• Live online and in-person workshops
• Coaching, mentoring, and consulting services
• Memberships and subscription-based services
• Educational videos, tutorials, demonstrations, and multimedia content
• Special events, promotions, contests, giveaways, and limited-time offerings
• Future products, services, technologies, digital offerings, or educational programs that may be introduced from time to time

We continually improve our products and services. Accordingly, we reserve the right, at any time and without prior notice, to add, modify, update, replace, discontinue, limit, or refuse any product, service, instructor, feature, promotion, or offering.

Product descriptions, specifications, photographs, dimensions, colors, pricing, availability, bonuses, and promotional materials are provided for informational purposes only. While we make every reasonable effort to ensure accuracy, we do not warrant that all information on our website is complete, current, or free from errors.

Because many of our products are handmade or original works of art, slight variations are natural and should be expected.

Nothing on our website guarantees the future availability of any product, service, instructor, feature, promotion, or offering.

6. Orders, Pricing & Payments

By placing an order through our website, you are making an offer to purchase a product or service subject to these Terms & Conditions.

All orders are subject to acceptance by us. We reserve the right to refuse, cancel, limit, or decline any order, in whole or in part, for any lawful reason, including but not limited to:

• Product availability
• Pricing or typographical errors
• Technical errors
• Payment authorization failure
• Suspected fraud
• Security concerns
• Violation of these Terms
• Orders believed to be placed by resellers or automated purchasing systems
• Compliance with applicable laws or governmental requirements

Prices are listed in U.S. Dollars (USD) unless otherwise stated.

Applicable sales taxes will be collected where required by law.

We currently accept payment through approved payment providers, including:

• Major credit cards
• Major debit cards
• PayPal
• Stripe and payment methods supported through Stripe

Accepted payment methods may change without prior notice.

If a pricing, technical, or typographical error results in an incorrect price or product description being displayed, we reserve the right to cancel or refuse the order prior to shipment, digital delivery, or course access, even after payment has been received. If payment has already been processed, a full refund of the amount paid will be issued.

Certain products or services may be offered through installment or payment plans. By selecting a payment plan, you agree to make all scheduled payments according to the payment schedule presented at checkout.

Failure to make scheduled payments may result in suspension or termination of access to digital products, online courses, memberships, coaching programs, or other services until your account has been brought current.

After any applicable refund period has expired, you remain responsible for all remaining payments due under your payment agreement.

Initiating a payment dispute or chargeback does not automatically cancel your contractual payment obligations. We reserve all legal rights to recover unpaid balances and may suspend or terminate your account while payment disputes are being investigated.

We reserve the right to verify payment information, request additional verification when appropriate, and refuse transactions that appear fraudulent, unauthorized, or intended to circumvent these Terms.

7. Customer Accounts

Certain products and services require you to create a customer account. Other products, particularly physical products, may be purchased using guest checkout without creating an account.

If you create an account, you agree to:

• Provide accurate, current, and complete information.
• Keep your account information updated.
• Maintain the confidentiality of your username and password.
• Accept responsibility for all activity occurring under your account.
• Notify us promptly if you suspect unauthorized access to your account.

Customer accounts are licensed to a single individual and may not be shared, transferred, assigned, sold, rented, sublicensed, or otherwise made available to another person without our prior written permission.

You are responsible for maintaining the security of your account and any activity that occurs under it.

We reserve the right to suspend, restrict, disable, or terminate any account that violates these Terms or is used for fraudulent, abusive, unlawful, unauthorized, or disruptive purposes.

By creating an account or making a purchase, you consent to receive electronic communications relating to your account, purchases, customer service inquiries, legal notices, security updates, policy changes, and other communications necessary to provide our products and services. Marketing communications are governed by our Privacy Notice and applicable law, and you may opt out of promotional emails at any time.

8. Refunds, Returns & Cancellations

Customer satisfaction is important to us. Because we offer a variety of physical products, digital products, educational programs, memberships, artwork, and custom services, refund eligibility varies depending on the product or service purchased.

The product-specific policies contained in Section 10 govern refunds, returns, exchanges, cancellations, and replacement requests for each type of product or service.

Unless otherwise stated:

• Refund requests must comply with the policy applicable to the specific product or service purchased.
• Refunds are issued solely at our discretion, except where prohibited by applicable law.
• Approved refunds will generally be issued to the original payment method.
• Shipping charges, expedited shipping fees, taxes, customs duties, gift wrapping charges, payment processing fees, and similar third-party charges are generally non-refundable unless required by law.
• Digital products that have been downloaded, accessed, streamed, or otherwise made available are generally non-refundable.
• Custom-made, personalized, or commissioned products are generally non-refundable once production has begun.
• Products identified as Final Sale, Clearance, Closeout, or Non-Returnable are not eligible for return or refund unless required by applicable law.

If a refund is approved, processing times may vary depending on your financial institution or payment provider.

We reserve the right to deny refund requests that do not comply with these Terms or that involve abuse of our refund policies, excessive return activity, fraudulent conduct, or misuse of our products or services.

Nothing contained in these Terms limits any consumer rights that cannot legally be waived under applicable law.

9. Memberships

Although Mattus Fine Art does not currently offer membership or subscription-based services, we may introduce memberships in the future under Mattus Fine Art, Mindful Artist Academy, Tiani's Handmade, or other affiliated brands.

If memberships become available, participation will be governed by these Terms & Conditions together with any additional membership terms provided at the time of enrollment.

Membership offerings may include, but are not limited to:

• Educational communities
• Premium learning libraries
• Coaching or mentoring programs
• Exclusive courses or workshops
• Live events
• Downloadable resources
• Creative communities
• Subscriber-only content
• Other recurring products or services

Membership Enrollment

By enrolling in a membership, you agree to pay all applicable membership fees and to comply with these Terms & Conditions and any additional membership policies applicable to your selected membership.

Memberships are intended for individual use only and may not be shared, transferred, assigned, resold, sublicensed, or otherwise made available to another individual or organization without our prior written permission.

Membership Billing

Memberships may be offered on a monthly, annual, or other recurring billing cycle.

Unless otherwise stated at the time of enrollment:

• Membership fees will automatically renew at the end of each billing cycle.
• Your payment method will be charged automatically unless you cancel before your next renewal date.
• You authorize us to charge your selected payment method for all recurring membership fees until your membership is cancelled.

Membership Cancellation

You may cancel your membership at any time through your account, by contacting customer support, or by any other cancellation method we make available.

Cancellation prevents future automatic renewals but does not automatically generate a refund for payments that have already been processed.

If you cancel:

• Monthly memberships will remain active until the end of the current monthly billing period.
• Annual memberships will remain active until the end of the current annual billing period.

Unless otherwise stated, no prorated refunds or partial credits will be issued after the applicable refund period has expired.

Membership Refund Policy

Unless otherwise stated for a particular membership, new memberships include a fourteen (14) calendar day refund period beginning on the date of purchase.

After the fourteen (14) day refund period has expired:

• Membership fees are non-refundable.
• Partial refunds will not be issued.
• Prorated refunds or credits will not be provided for unused time remaining in a billing period.

If a refund is approved within the applicable refund period, access to membership content may be terminated upon processing of the refund.

Membership Changes

We reserve the right to modify, improve, replace, suspend, or discontinue any membership program, including its pricing, features, benefits, content, instructors, community platforms, or available resources.

Whenever reasonably practical, members will receive advance notice of material changes before they become effective.

Member Conduct

Members are expected to interact respectfully with instructors, staff, moderators, guest presenters, and fellow members.

The following activities are prohibited within any membership community:

• Harassment or bullying
• Threatening or abusive behavior
• Discrimination or hate speech
• Spam or unsolicited advertising
• Sharing copyrighted materials without authorization
• Sharing membership login credentials
• Recording or redistributing member-only content without permission
• Disruptive or unlawful conduct
• Any activity that interferes with the operation of the membership community

Suspension or Termination of Membership

We reserve the right to suspend, restrict, or terminate membership access, without refund where permitted by law, if we reasonably determine that a member has:

• Violated these Terms & Conditions
• Violated our Community Guidelines
• Shared copyrighted materials or membership content without authorization
• Shared account credentials
• Engaged in fraudulent activity
• Failed to pay membership fees
• Disrupted the membership community
• Engaged in unlawful, abusive, or inappropriate conduct

Termination of membership does not relieve a member of any outstanding financial obligations incurred before termination.

Discontinuation of Membership Programs

If we permanently discontinue a membership program, we will determine an appropriate resolution based on the circumstances, applicable law, and the remaining value of any prepaid membership period.

Nothing in this section limits any consumer rights that cannot legally be waived under applicable law.

10. Product-Specific Terms

Mattus Fine Art offers a variety of physical products, digital products, educational programs, and creative services through Mattus Fine Art, Mindful Artist Academy, and Tiani's Handmade. Because each product or service is unique, additional terms apply to certain purchases.

The policies in this section are intended to explain product-specific expectations, customer responsibilities, inspections, returns, refunds, cancellations, fulfillment, and other terms applicable to particular products and services.

If a product-specific term conflicts with another provision of these Terms & Conditions, the product-specific term will govern for that particular product or service.

10.1 Original Artwork & Fine Art Prints

Mattus Fine Art offers original artwork, commissioned artwork, limited edition and open edition fine art prints, and other fine art products created by professional artist Joe Mattus.

We make every reasonable effort to accurately represent our artwork through photographs, videos, and written descriptions. However, actual colors, textures, framing, and overall appearance may vary slightly due to photography, lighting conditions, printing processes, monitor settings, mobile device displays, and the handcrafted nature of original artwork.

Every original work of art is individually created by hand, making each piece one of a kind. Variations in brushwork, pencil strokes, charcoal marks, paint application, texture, paper, canvas, framing materials, or other artistic characteristics are a natural part of the creative process and are not considered defects.

Artwork availability is subject to prior sale. An order is not considered accepted until payment has been successfully processed and you receive an order confirmation from us.

Certificate of Authenticity

Unless otherwise stated, original artwork purchased from Mattus Fine Art may include a Certificate of Authenticity signed by the artist.

The Certificate of Authenticity verifies the originality of the artwork and should be retained for your records. Loss or damage of the certificate does not affect ownership of the artwork, although replacement certificates may not always be available.

Inspection Upon Delivery

Please inspect your artwork promptly after delivery.

If you believe your artwork was damaged during shipment or you received an incorrect item, please contact us as soon as reasonably possible. We may request photographs of the artwork, shipping container, and packaging materials to assist in evaluating the claim.

Shipping procedures are governed by Section 10.6 – Shipping, Delivery & Fulfillment.

Artwork Return Policy

We want you to be completely satisfied with your artwork purchase.

Unless otherwise required by applicable law, eligible original artwork and fine art prints may be returned within seven (7) calendar days after delivery provided that:

 

• The artwork is returned in its original condition.

• The artwork has not been altered, damaged, or displayed in a manner that affects its condition.

• The artwork is returned in its original packaging or packaging providing equivalent protection.

• Return authorization has been obtained before the artwork is shipped back.

 

Unless the return results from our error or shipping damage, customers are responsible for return shipping costs.

Approved returns are subject to a twenty percent (20%) restocking fee to help offset inspection, handling, packaging, processing, and administrative costs.

Original shipping charges, expedited shipping fees, insurance charges, customs duties, taxes, and similar third-party charges are generally non-refundable unless required by applicable law.

Refunds will be issued to the original payment method after the returned artwork has been received, inspected, and approved.

Commissioned Artwork

We are honored to create commissioned artwork for our clients.

Commissioned artwork is created specifically for an individual customer and requires planning, consultation, artistic skill, labor, and materials that generally cannot be recovered if a project is cancelled after work has begun.

Unless otherwise agreed in writing:

 

• A deposit or full payment may be required before work begins.

• Customers are responsible for reviewing and approving all project specifications before production begins.

• Completion dates are estimates only and are not guaranteed.

• Requests for changes after approval may result in additional charges and revised completion dates.

• Deposits are generally non-refundable once work has begun.

• Completed commissioned artwork is generally non-refundable except where required by applicable law or if damage occurs during shipment.

 

Customers acknowledge that commissioned artwork reflects the artist's professional judgment, artistic style, and creative interpretation. Reasonable artistic interpretation is an inherent part of creating original artwork and is not considered a defect.

We may decline or cancel any commissioned project that:

 

• Violates applicable law.

• Infringes upon another person's intellectual property or legal rights.

• Contains offensive, defamatory, hateful, discriminatory, or otherwise inappropriate subject matter.

• Cannot reasonably be completed using available materials or artistic techniques.

• Conflicts with our artistic standards, professional ethics, or business practices.

 

Ownership of the physical artwork does not transfer ownership of any copyright or other intellectual property rights. Intellectual property ownership is governed by Section 11 – Intellectual Property Rights.

Shipping, insurance, delivery, and fulfillment for commissioned artwork are governed by Section 10.6 – Shipping, Delivery & Fulfillment.

10.2 Handmade Products

Tiani's Handmade, a brand of Mattus Fine Art, offers individually handcrafted blankets, plush toys, gifts, nursery items, home décor, seasonal products, and other handmade creations.

Every handmade item is individually crafted rather than mass-produced. As a result, each piece reflects the care, creativity, and craftsmanship that make handmade products unique.

Characteristics of Handmade Products

Because every item is handcrafted, slight variations are natural and should be expected. These variations are part of the character and authenticity of handmade craftsmanship and are not considered defects.

Variations may include, but are not limited to:

 

• Overall dimensions

• Stitch placement or stitch tension

• Yarn texture and fiber characteristics

• Color variations resulting from manufacturer dye lots

• Pattern placement

• Shape and appearance of handmade plush toys

• Natural variations in handcrafted construction

• Minor differences between product photographs and the finished item

 

We make every reasonable effort to create products that closely resemble the photographs displayed on our website. However, no two handmade products will ever be exactly alike.

If a yarn, stuffing material, embellishment, or other component becomes unavailable, we may substitute a comparable material of similar quality, appearance, and function. If a substitution would materially change a custom order, we will make reasonable efforts to contact you before proceeding.

Product Care

Each handmade product includes care instructions based on the recommendations provided by the manufacturer of the yarn and materials used to create that item.

Please follow the care instructions included with your purchase to help preserve the appearance, softness, durability, and longevity of your handmade item.

We are not responsible for damage resulting from:

 

• Failure to follow the provided care instructions

• Improper washing or drying

• Use of bleach, harsh chemicals, or detergents not recommended by the manufacturer

• Use of fabric softeners when not recommended

• Excessive heat or ironing

• Pet damage

• Accidental damage

• Alterations or repairs made after purchase

• Misuse

• Normal wear and tear

 

Failure to follow the provided care instructions may affect eligibility for returns, exchanges, replacements, or other remedies, except where prohibited by applicable law.

Inspection Upon Delivery

Please inspect your handmade purchase promptly after delivery.

If you receive an incorrect item or believe your order was damaged during shipment, please contact us as soon as reasonably possible. We may request photographs of the product, shipping container, and packaging materials to assist in evaluating the claim.

Shipping procedures are governed by Section 10.6 – Shipping, Delivery & Fulfillment.

Return & Exchange Policy

We want you to be delighted with your handmade purchase.

Unless otherwise required by applicable law, eligible handmade products may be returned or exchanged within fourteen (14) calendar days after delivery provided that:

 

• The item is unused and in its original condition.

• The item is free from stains, odors, smoke, pet hair, excessive wear, or other damage occurring after delivery.

• Original tags, packaging, and included materials are returned when applicable.

• Return authorization has been obtained before the item is shipped back.

 

Unless the return results from our error or shipping damage, customers are responsible for return shipping costs.

Original shipping charges, expedited shipping fees, gift wrapping charges, customs duties, taxes, and similar third-party charges are generally non-refundable unless required by applicable law.

Approved refunds will be issued to the original payment method after the returned item has been received, inspected, and approved.

Non-Returnable Handmade Products

Unless otherwise required by applicable law, the following items are generally not eligible for return, exchange, or refund:

 

• Custom-made or personalized products

• Commissioned handmade items

• Products marked "Final Sale," "Clearance," or "Non-Returnable"

• Products that have been used, washed, altered, repaired, or damaged after delivery

• Products damaged through improper care, misuse, accidents, pets, or normal wear and tear

 

Custom Handmade Products

We are pleased to create custom handmade blankets, plush toys, gifts, and other handcrafted items whenever reasonably possible.

Because custom products are created specifically for an individual customer:

 

• A deposit or full payment may be required before production begins.

• Customers are responsible for reviewing and approving all specifications before work begins.

• Completion dates are estimates only and are not guaranteed.

• Changes requested after approval may result in additional charges or revised completion dates.

• Deposits are generally non-refundable once production has begun.

• Completed custom handmade products are generally non-refundable except where required by applicable law or if damage occurs during shipment.

 

Shipping, insurance, delivery, and fulfillment for custom handmade products are governed by Section 10.6 – Shipping, Delivery & Fulfillment.

10.3 Digital Products

Mattus Fine Art, Mindful Artist Academy, and Tiani's Handmade offer a variety of digital products delivered electronically. Unless expressly stated otherwise, digital products do not include a physical item.

Digital products may include, but are not limited to:

 

• Knitting patterns

• Printable resources

• PDF guides

• Workbooks

• Templates

• Checklists

• Educational materials

• Digital artwork

• Video tutorials

• Downloadable resources

• Resource libraries

• Future digital products and electronic downloads

 

Electronic Delivery

Digital products are generally delivered through a download link, customer account, email, or another electronic delivery method we designate.

Delivery times may vary depending on payment processing, system availability, internet connectivity, and email delivery. Most digital products are available shortly after payment has been successfully processed.

Customers are responsible for providing a valid email address and ensuring they can receive communications from us.

Download Responsibilities

Customers are responsible for downloading and securely saving purchased digital products after they become available.

We strongly recommend maintaining backup copies of all purchased files for your personal use.

We are not responsible for digital products that become unavailable due to:

 

• Accidental deletion

• Lost or damaged devices

• Hard drive or storage failure

• Software corruption

• Lost passwords

• Email account issues

• Failure to download products during any applicable access period

• Failure to maintain backup copies

 

When reasonably possible, we may provide replacement download links as a courtesy. However, we are not obligated to do so.

Technical Requirements

Customers are responsible for ensuring their computer, mobile device, software, printer (when applicable), internet connection, and other equipment are compatible with the digital products purchased.

We are not responsible for technical issues resulting from:

 

• Unsupported devices

• Outdated software

• Internet connectivity problems

• Third-party applications

• Customer computer or device malfunctions

• Software updates made by third-party providers

• Compatibility issues beyond our reasonable control

 

Product Updates

We continually improve our digital products and may revise, update, expand, replace, correct, or discontinue them from time to time.

Unless expressly stated otherwise, purchasing a digital product does not entitle you to future revisions, expanded editions, bonus materials, updated versions, or replacement products.

When appropriate, we may choose to provide updated versions to previous purchasers at our discretion.

If a digital product is discontinued, previously completed purchases will generally not be affected unless continued access depends upon an online platform, service, or technology that is no longer available.

Digital Product Accuracy

We make every reasonable effort to ensure our digital products are accurate, complete, and useful.

Occasionally, digital products may contain typographical errors, formatting issues, or other inadvertent inaccuracies. We may correct these errors and update digital products without prior notice.

Digital Product Refund Policy

Because digital products are delivered electronically and may be downloaded or accessed immediately after purchase, all sales of digital products are generally final.

Unless otherwise required by applicable law:

 

• Digital products are non-refundable once access has been provided or a download has been made available.

• Refunds are not issued because you changed your mind, purchased the incorrect product, no longer need the product, or did not review the product description before purchasing.

• Refunds are not issued because of compatibility issues with your personal devices, software, printer, internet connection, or other equipment.

 

If you experience difficulty accessing a purchased digital product, please contact us. We will make reasonable efforts to assist you.

Customer Responsibilities

By purchasing a digital product, you acknowledge and agree that:

 

• You have reviewed the product description before purchasing.

• You understand that the product will be delivered electronically.

• You are responsible for maintaining access to your email account and downloaded files.

• You are responsible for maintaining backup copies of your purchased files.

• You are responsible for ensuring your devices and software meet the technical requirements necessary to use the product.

 

Ownership, licensing, copyright protections, artificial intelligence restrictions, and permitted uses of digital products are governed by Section 11 – Intellectual Property Rights.

10.4 Online Courses & Educational Programs

Enrollment

Enrollment is complete once payment has been successfully processed or an approved payment plan has been established.

Enrollment provides access only to the specific educational program purchased unless otherwise stated at the time of purchase.

Course enrollments are personal to the purchaser and may not be transferred, assigned, shared, resold, or otherwise provided to another individual without our prior written permission.

Course Access & Availability

Access to educational materials varies by program and will be described on the applicable sales page at the time of purchase.

Some programs may provide lifetime access, while others provide access for a limited period, scheduled duration, or subscription term.

For purposes of these Terms, "lifetime access" means access for as long as Mattus Fine Art continues to own, maintain, and make the course available on the applicable platform. Lifetime access does not guarantee access for the lifetime of the purchaser or the continued availability of any third-party platform, software, or technology.

We may revise, improve, rename, consolidate, replace, retire, or discontinue courses and educational programs from time to time.

If a course is retired after purchase, we may provide continued access for a reasonable period, offer substantially similar replacement content, or provide another appropriate remedy consistent with applicable law.

Course Updates

We continually improve our educational programs and may:

 

• Revise course content

• Update lessons

• Replace or improve videos

• Correct errors

• Update downloadable materials

• Add or remove bonus content

• Modify assignments or demonstrations

• Improve course organization and navigation

 

These updates are intended to enhance the educational experience and do not constitute a reduction in the value of the course.

Live Classes, Workshops & Coaching

Certain educational programs include live online classes, workshops, coaching sessions, critiques, office hours, or question-and-answer sessions.

Unless otherwise stated:

 

• Attendance at live sessions is the responsibility of the enrolled student.

• We are not responsible for missed sessions resulting from scheduling conflicts, illness, technical issues on the student's end, or other personal circumstances.

• Live sessions may or may not be recorded.

• If recordings are provided, access to those recordings will be determined at our discretion.

 

When reasonably necessary, we may substitute instructors, guest presenters, lesson schedules, class dates, or meeting platforms.

Student Responsibilities

Students are responsible for:

 

• Reviewing the course description before enrolling.

• Maintaining compatible equipment, internet access, and required software.

• Completing assignments and practice exercises independently.

• Maintaining the confidentiality of account credentials.

• Treating instructors, staff, guest presenters, and fellow students with respect.

• Using course materials only as permitted by these Terms & Conditions.

 

Individual success depends upon each student's effort, practice, experience, dedication, and implementation of the educational material provided.

Payment Plans

Some educational programs may be offered through installment or payment plans.

By selecting a payment plan, you agree to make all scheduled payments according to the payment schedule presented during checkout.

Failure to make scheduled payments may result in suspension of course access until your account has been brought current.

After the applicable refund period expires, you remain responsible for completing all remaining scheduled payments.

Course Refund Policy

Unless otherwise stated on the applicable course sales page, educational programs include a fourteen (14) calendar day refund period.

For self-paced courses, the refund period begins on the date of purchase because access is generally provided immediately.

For scheduled courses, live workshops, or cohort-based programs, the refund period begins on the official course start date unless otherwise stated during enrollment.

Refund requests must be submitted before the applicable refund period expires.

After the applicable refund period expires:

 

• Course purchases are non-refundable.

• Partial refunds are not provided.

• Payment plan obligations remain in effect.

• Refunds will not be issued because a student did not complete the course, failed to achieve desired results, lacked time to participate, missed live sessions, or simply changed their mind.

 

If a refund is approved, access to the course, downloadable materials, bonus content, and associated educational resources may be terminated when the refund is processed.

Nothing in this section limits any consumer rights that cannot legally be waived under applicable law.

Educational Disclaimer

Our educational programs are intended to provide instruction, demonstrations, guidance, and educational information.

We do not guarantee:

 

• Artistic improvement

• Mastery of any artistic technique

• Business success

• Financial results

• Employment opportunities

• Professional certification

• Any specific outcome resulting from participation in our educational programs

 

Each student's results depend upon numerous factors beyond our control, including individual ability, practice, dedication, experience, and implementation of the educational material provided.

Student Conduct

Students are expected to conduct themselves respectfully and professionally.

We may suspend or terminate access to an educational program, without refund where permitted by law, if a student:

 

• Violates these Terms & Conditions

• Violates our Community Guidelines

• Shares course materials without authorization

• Shares account credentials

• Harasses instructors, staff, guest presenters, or other students

• Engages in unlawful, abusive, threatening, discriminatory, or disruptive conduct

 

Cancellation or Modification of Educational Programs

When reasonably necessary, we may postpone, reschedule, modify, substitute, or cancel any educational program, instructor, workshop, coaching session, lesson, or live event due to illness, emergencies, technical issues, insufficient enrollment, circumstances beyond our reasonable control, or other legitimate business reasons.

If we cancel a paid educational program before it begins and do not provide a substantially equivalent alternative, affected students will be offered an appropriate remedy, which may include rescheduling, course credit, or a refund, as determined by us and applicable law.

Ownership, licensing, copyright protections, recording restrictions, artificial intelligence restrictions, and permitted uses of educational materials are governed by Section 11 – Intellectual Property Rights.

 

10.5 Custom Orders, Personalized Products & Commissioned Work

We are pleased to offer custom artwork, commissioned artwork, personalized handmade products, and other custom creative services through Mattus Fine Art and Tiani's Handmade.

Because each custom project is created specifically for an individual customer, additional terms apply beyond those governing our standard products.

Custom projects may include, but are not limited to:

• Original artwork
• Portrait commissions
• Custom paintings or drawings
• Personalized blankets
• Custom plush toys
• Personalized gifts
• Custom color combinations
• Custom sizes
• Personalized lettering or embroidery (when offered)
• Other custom creative projects accepted by us

Acceptance of Custom Projects

Acceptance of any custom order or commissioned project is at our discretion.

We may decline or cancel a project that:

• Violates applicable law.
• Infringes upon another person's intellectual property or legal rights.
• Contains offensive, hateful, defamatory, discriminatory, or otherwise inappropriate content.
• Cannot reasonably be completed using available materials, equipment, or artistic techniques.
• Conflicts with our artistic standards, professional ethics, production schedule, business practices, or available resources.

Quotes & Estimates

Quotes, production schedules, completion dates, and shipping estimates are provided in good faith but are estimates only and are not guaranteed.

Unless otherwise stated, quotes are valid only for the period identified in the quotation. If no expiration date is provided, pricing may be adjusted to reflect changes in material costs, labor, shipping expenses, or other factors before the project is accepted.

Deposits & Payments

Custom projects may require a deposit or full payment before production begins. Any required deposit or payment schedule will be communicated before work starts.

Unless otherwise agreed in writing:

• Production will not begin until any required deposit has been received.
• Production will not begin until all required customer approvals have been received.
• Remaining balances are due according to the agreed payment schedule.
• Completed work will not be shipped, delivered, or released until all outstanding balances have been paid in full.

Customer Responsibilities

Customers are responsible for:

• Providing complete and accurate project information.
• Providing suitable reference photographs when applicable.
• Responding promptly to requests for information or approvals.
• Carefully reviewing all sketches, proofs, mock-ups, personalization, names, dates, spelling, measurements, colors, and other project specifications before granting approval.

Delays in customer communication or approvals may extend production schedules.

Customer Approval

Approval of a sketch, proof, mock-up, color selection, personalization, or other project specifications constitutes acceptance of those specifications.

We are not responsible for customer-approved errors, including but not limited to:

• Spelling
• Grammar
• Names
• Dates
• Measurements
• Colors
• Personalization
• Wording
• Other approved design elements

Once production begins, requested changes may not be possible and may result in additional charges, revised completion dates, or the creation of a new custom order.

Materials & Artistic Variations

Many custom projects are individually handcrafted using materials that naturally vary.

Minor variations in:

• Color
• Yarn dye lots
• Fabric
• Texture
• Brushwork
• Pencil or charcoal strokes
• Wood grain
• Stitch placement
• Overall appearance

are normal characteristics of handmade craftsmanship and original artwork and are not considered defects.

If materials become unavailable, we may substitute comparable materials of similar quality and appearance. If a substitution would materially change the finished project, we will make reasonable efforts to obtain customer approval before proceeding.

Color Matching

We make every reasonable effort to match requested colors.

However, colors displayed on computer monitors, mobile devices, tablets, printed photographs, paint samples, fabrics, yarns, inks, and other materials may differ from the finished product. Exact color matching cannot be guaranteed.

Customer-Supplied Reference Materials

If you provide photographs, artwork, logos, names, designs, or other materials for use in a custom project, you represent that you have the legal right to use those materials.

For portrait commissions and similar artwork, the quality of the finished piece depends upon the quality of the reference photographs provided. We are not responsible for limitations in the finished artwork resulting from blurry, low-resolution, poorly lit, incomplete, or otherwise unsuitable reference images.

You agree to indemnify and hold us harmless from claims arising from materials you provide.

Artistic Interpretation

Commissioned artwork reflects the artist's professional judgment, artistic style, and creative interpretation.

Unless otherwise agreed in writing, customers acknowledge that reasonable artistic interpretation is an inherent part of creating original artwork and is not considered a defect.

Production Time

Estimated production schedules and completion dates are provided in good faith but are not guaranteed.

Production schedules may be affected by:

• Customer response times
• Customer approval delays
• Design revisions
• Material availability
• Supply chain disruptions
• Shipping carrier delays
• Illness
• Weather events
• Equipment failures
• Holidays
• Other circumstances beyond our reasonable control

We will make reasonable efforts to keep customers informed of significant delays.

Rush Orders

From time to time, we may agree to expedite a custom project.

Acceptance of a rush order does not guarantee completion by a specific date unless we have expressly agreed to that date in writing.

Cancellation of Custom Orders

Customers may request cancellation before production begins.

Once production has begun:

• Deposits are generally non-refundable.
• Materials purchased specifically for the project are generally non-refundable.
• Labor already performed is generally non-refundable.
• Completed custom work is generally non-refundable except where required by applicable law.

Abandoned Projects

Timely customer communication is essential to completing custom work.

If we request information, approvals, photographs, or other materials necessary to complete a project and do not receive a response within thirty (30) calendar days, we may place the project on hold.

If a project remains inactive for ninety (90) calendar days, we may consider the project abandoned.

For abandoned projects, we may:

• Cancel the project.
• Retain any non-refundable deposits to cover work already completed.
• Charge additional fees if work later resumes.
• Require updated pricing if material or labor costs have increased.

Ownership

Upon full payment, ownership of the completed physical artwork or handmade product transfers to the customer.

Ownership of the physical item does not transfer any copyright, trademark, design rights, reproduction rights, or other intellectual property rights unless expressly assigned in a separate written agreement signed by us.

Photography & Portfolio Rights

Unless otherwise agreed in writing before production begins, we may photograph, display, publish, reproduce, and use completed custom work for portfolios, exhibitions, competitions, educational purposes, advertising, our website, social media, and other promotional materials.

If a customer requests that a commissioned project remain private, we will make reasonable efforts to honor that request when agreed to in writing before production begins.

Shipping & Delivery

Shipping charges, processing times, insurance, delivery estimates, damaged shipments, lost packages, and all other shipping-related matters are governed by Section 10.6 – Shipping, Delivery & Fulfillment.

10.6 Shipping, Delivery & Fulfillment

This section applies to all physical products sold through Mattus Fine Art, including original artwork, fine art prints, handmade products, commissioned artwork, custom orders, and any future physical products unless otherwise stated.

Processing Times

Processing times vary depending on the type of product purchased.

Ready-to-ship products are generally processed within the timeframe stated on the applicable product page.

Custom orders, commissioned artwork, and made-to-order products require additional production time before shipment.

Business days do not include weekends or federal holidays.

Estimated processing and shipping dates are provided in good faith but are estimates only and are not guaranteed.

Shipping Charges

Shipping charges are calculated at checkout based on:

• Package size
• Weight
• Shipping destination
• Shipping method selected
• Shipping insurance, when applicable

Because many handmade products vary in size and weight, shipping costs may differ depending on the item ordered.

Oversized or unusually heavy items may require additional shipping charges. If additional shipping charges apply, we will notify you before completing your order whenever reasonably possible.

Shipping Locations

At this time, we ship only to addresses within the United States.

We may expand shipping to additional countries or regions in the future. If international shipping becomes available, additional shipping terms and conditions will apply and will be disclosed at that time.

We may limit or decline shipments to certain locations when reasonably necessary because of legal restrictions, carrier limitations, fraud prevention, safety concerns, or other operational considerations.

Shipping Address

Customers are responsible for providing a complete and accurate shipping address.

We are not responsible for delays, returned shipments, additional shipping charges, or delivery failures resulting from incorrect or incomplete shipping information provided by the customer.

If an order is returned because of an incorrect address, refusal of delivery, or failure to claim the package from the shipping carrier, the customer is responsible for any additional shipping charges required to resend the order.

Risk of Loss

Unless otherwise required by applicable law, risk of loss and title for physical products transfer to the customer when the shipment is delivered to the shipping carrier.

Delivery Estimates

Estimated shipping and delivery dates are provided as a convenience only and are not guaranteed.

Delivery times may be affected by circumstances beyond our reasonable control, including:

• Severe weather
• Natural disasters
• Shipping carrier delays
• Holidays
• Supply chain disruptions
• Labor shortages
• Government actions
• Utility outages
• Other unforeseen events

Once a shipment has been accepted by the shipping carrier, carrier-related delivery delays are outside our control.

Tracking Information

When available, tracking information will be provided after your order has shipped.

Customers are responsible for monitoring shipment tracking and making reasonable arrangements to receive deliveries.

Signature Confirmation

For certain purchases, including original artwork, commissioned artwork, or other high-value items, we may require signature confirmation upon delivery.

If signature confirmation is required, delivery will be considered complete when the shipment has been signed for at the delivery address provided by the customer.

Inspection Upon Delivery

Please inspect your order promptly upon delivery.

If you receive an incorrect item or believe your shipment was damaged during transit, please contact us as soon as reasonably possible.

To assist in evaluating the claim, we may request:

• Photographs of the product
• Photographs of the shipping carton
• Photographs of the packaging materials
• A description of the damage
• Any other information reasonably necessary to process the claim

Please retain all original packaging materials until the claim has been resolved.

Lost or Damaged Shipments

If a shipment is lost or arrives damaged, we will work with the shipping carrier to investigate the matter and determine an appropriate resolution.

Customers agree to cooperate with any reasonable requests necessary to process shipping claims.

Depending on the circumstances, an appropriate remedy may include repair, replacement, refund, insurance claim processing, or another solution consistent with these Terms & Conditions and applicable law.

Events Beyond Our Control

We are not responsible for delays or failure to fulfill our obligations when caused by circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, fire, flood, pandemic, epidemic, war, terrorism, labor disputes, transportation interruptions, government actions, utility outages, internet failures, supply shortages, or other unforeseen events.

If you have questions regarding shipping, delivery, or a shipment issue, please contact us as soon as reasonably possible.

Whenever practical, we will work with you and the shipping carrier to help resolve shipping-related issues promptly and fairly.

11. Intellectual Property & Acceptable Use

Mattus Fine Art, including its affiliated brands Mindful Artist Academy and Tiani's Handmade, creates and offers original artwork, educational materials, handmade designs, digital products, and other creative works that represent significant investments of time, skill, creativity, and experience.

Protecting our intellectual property allows us to continue creating original products, educational resources, and artistic works for our customers.

Unless otherwise stated in writing, all intellectual property displayed on this website or provided through our products and services is owned by Mattus Fine Art or is used under a valid license.

Nothing contained in these Terms & Conditions transfers ownership of any intellectual property to you.

11.2 Ownership

All intellectual property remains the exclusive property of Mattus Fine Art or its licensors unless expressly stated otherwise in writing.

Purchasing artwork, handmade products, knitting patterns, digital downloads, online courses, educational materials, memberships, or any other product or service does not transfer ownership of any copyright, trademark, design right, trade secret, patent, or other intellectual property right.

Ownership of a physical item transfers only ownership of that physical item unless a separate written agreement expressly provides otherwise.

11.3 Limited License

Unless otherwise stated in writing, purchasing one of our products grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the purchased product for its intended purpose.

This license does not permit you to:

• Copy, reproduce, or redistribute our work except as expressly permitted by these Terms.
• Sell, license, sublicense, lease, rent, or distribute our products.
• Upload our products to file-sharing websites or online marketplaces.
• Share digital downloads with another person.
• Share online course access or account credentials.
• Record, copy, or rebroadcast our educational programs.
• Remove copyright notices, trademarks, or watermarks.
• Claim our work as your own.
• Use our content to create competing products or services.
• Use our content in a manner that violates applicable law.

Any rights not expressly granted remain reserved by Mattus Fine Art.

11.4 Knitting Patterns & Finished Handmade Items

Tiani's Handmade knitting patterns are protected by copyright law.

When you purchase one of our knitting patterns, you receive permission to use that pattern to create handmade finished items for your own personal use or for individual resale.

You may sell handmade finished items that you personally create from an authorized Tiani's Handmade pattern, provided that:

• The finished items are individually handmade by you.
• The finished items are not mass-produced or commercially manufactured.
• The pattern itself is not copied, shared, distributed, translated, republished, resold, licensed, or claimed as your own work.

Purchasing a pattern does not permit you to:

• Copy the pattern.
• Email or share the pattern with others.
• Upload the pattern to websites or social media.
• Sell or redistribute the pattern in any format.
• Teach the pattern as your own without written permission.
• Create derivative versions of the written instructions for resale or distribution.

The copyright protects the written pattern, photographs, graphics, layout, and other original content—not the finished handmade item created by the purchaser.

11.5 Copyright Protection

All content published by Mattus Fine Art is protected by United States and applicable international copyright laws.

Unless expressly authorized in writing, no artwork, photographs, knitting patterns, course materials, videos, written content, downloadable resources, marketing materials, website content, or other copyrighted material may be copied, reproduced, modified, translated, published, distributed, displayed, transmitted, stored, or otherwise used except as permitted by applicable law.

Unauthorized use may result in suspension or termination of access to our products and services and may also result in legal action.

11.6 Trademarks, Artificial Intelligence & Automated Systems

Mattus Fine Art, Mindful Artist Academy, Tiani's Handmade, our logos, product names, course names, slogans, and other branding elements are trademarks, service marks, trade names, or proprietary identifiers owned by us or used under license.

Nothing contained in these Terms grants permission to use our trademarks without our prior written consent.

Our intellectual property may not be used to train, develop, improve, evaluate, or operate artificial intelligence systems, machine learning models, large language models, image generation systems, or similar technologies without our prior written permission.

Unless expressly authorized in writing, you may not:

• Use our artwork, knitting patterns, photographs, videos, educational materials, or written content to train artificial intelligence systems.
• Scan, digitize, or convert our patterns or educational materials for use by artificial intelligence.
• Scrape, harvest, crawl, download, copy, or extract content from our website or digital platforms using automated tools, bots, spiders, scripts, or similar technologies.
• Create datasets, databases, or derivative works using our content for artificial intelligence or automated processing.
• Remove copyright notices, metadata, digital signatures, or watermarks from our content.

These restrictions apply whether the activity is performed manually or through automated means.

11.7 User-Generated Content

From time to time, you may voluntarily submit comments, reviews, testimonials, photographs, videos, artwork, project photos, questions, suggestions, social media posts, or other content ("User Content") to Mattus Fine Art.

You retain ownership of your original User Content.

However, by submitting User Content to us, tagging us on social media, participating in contests or promotions, or otherwise providing content for publication, you grant Mattus Fine Art a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, publish, display, distribute, edit, adapt, translate, and promote that content in connection with our business, products, services, marketing, advertising, educational materials, website, social media platforms, and future promotional activities, unless otherwise agreed in writing.

You represent and warrant that:

• You own the User Content or have the legal right to submit it.
• Your User Content does not infringe the rights of another person or entity.
• Your User Content does not violate any applicable law.
• Your User Content does not contain unlawful, defamatory, abusive, fraudulent, misleading, or otherwise objectionable material.

We may, but are not obligated to, monitor, edit, remove, refuse to publish, or otherwise moderate User Content at our discretion.

11.8 Educational & Classroom Use

Our educational materials are intended solely for the personal use of the enrolled student or purchaser.

Unless we provide prior written permission, you may not:

• Teach our courses as your own.
• Present our course materials in a classroom, workshop, guild, club, library, school, business, or other group setting.
• Copy or distribute course handouts, workbooks, presentations, videos, knitting patterns, or downloadable materials.
• Upload educational materials to learning management systems, file-sharing websites, or cloud storage for group access.
• Record, rebroadcast, livestream, or otherwise distribute our live classes, webinars, workshops, coaching sessions, or demonstrations.
• Incorporate our educational materials into another course, training program, publication, or educational resource.

Organizations wishing to license our educational materials for classroom or group instruction should contact us to discuss licensing opportunities.

11.9 Commercial Use

Unless expressly permitted in these Terms & Conditions or authorized by us in writing, our intellectual property may not be used for commercial purposes.

Commercial use includes, but is not limited to:

• Selling copies of our work.
• Licensing or sublicensing our content.
• Republishing our materials.
• Creating competing educational products or services.
• Using our artwork, photographs, videos, or written materials in advertising, marketing, or promotional materials.
• Offering our educational content for paid instruction.
• Manufacturing products based upon our copyrighted materials.

Knitting Pattern Exception

Customers may sell individual handmade items that they personally create using an authorized Tiani's Handmade knitting pattern, provided that:

• Each item is individually handmade by the purchaser.
• The items are not mass-produced or commercially manufactured.
• The pattern itself is not copied, shared, redistributed, republished, translated, resold, licensed, or otherwise distributed.
• The purchaser complies with all other applicable provisions of these Terms & Conditions.

While attribution such as "Made from a pattern by Tiani's Handmade" is appreciated, it is not required unless expressly stated with the pattern.

Customers may not state or imply that Mattus Fine Art, Tiani's Handmade, or Mindful Artist Academy endorses, sponsors, certifies, approves of, or is otherwise affiliated with their business, products, or services without our prior written permission.

Nothing in this section grants permission to use our trademarks, logos, business names, product names, branding, marketing materials, or other proprietary identifiers in a manner likely to cause confusion regarding the source, sponsorship, endorsement, or affiliation of any product, service, or business.

11.10 No Data Mining or Automated Collection

To help protect our intellectual property and the integrity of our website and services, you may not use automated means to collect, copy, monitor, or extract content from our website or digital platforms without our prior written permission.

Prohibited activities include, but are not limited to:

• Data mining.
• Web scraping.
• Content harvesting.
• Bulk downloading.
• Automated copying of text, images, product listings, or pricing.
• Harvesting email addresses or customer information.
• Creating databases from our content.
• Using bots, spiders, crawlers, scripts, or similar automated technologies to collect information from our website.

These restrictions apply regardless of whether the collected information is intended for commercial, research, artificial intelligence, or other purposes.

11.11 Copyright Infringement

We respect the intellectual property rights of others and expect our customers and website visitors to do the same.

If you believe material appearing on our website infringes your copyright or other intellectual property rights, please contact us with sufficient information to investigate your claim.

We may remove, disable access to, or investigate allegedly infringing material while we review the matter.
